젬 컬러링 이용약관

1약관의 적용

이 약관은 개인 개발자 salary crew(이하 "개발자")가 제공하는 모바일 게임 젬 컬러링(Gem Coloring)(이하 "앱")의 이용 조건을 정합니다. 앱을 내려받아 설치하거나 사용하면 이 약관에 동의한 것으로 봅니다. 동의하지 않으시면 앱을 사용하지 마시고 삭제해 주세요.

앱을 내려받은 스토어(Apple App Store, Google Play)의 약관도 함께 적용되며, 이 약관과 스토어 약관이 충돌하는 부분에서는 스토어 약관이 우선합니다.

2서비스의 내용

• 앱은 뒤섞인 보석을 제자리에 돌려놓아 그림을 완성하는 싱글 플레이 퍼즐 게임입니다.
• 회원가입·로그인이 없고, 이용자 사이의 채팅이나 대전 같은 상호작용 기능이 없습니다.
• 도안을 내려받은 뒤에는 인터넷 없이도 플레이할 수 있습니다. 광고를 보려면 인터넷 연결이 필요합니다.
• 앱은 무료로 내려받을 수 있고, 광고로 운영합니다. 광고를 없애는 유료 상품이 하나 있습니다(6항).
• 한국어 · English · 日本語 를 지원합니다.

3이용자의 게임 데이터

깬 도안·별 등급·진행 상태·보석·마법봉·설정은 이용자의 기기 안에만 저장됩니다. 개발자는 이 데이터를 보관하는 서버를 두고 있지 않습니다.

따라서 다음의 경우 게임 데이터는 복구할 수 없습니다. 이 점을 미리 알려 드립니다.

• 앱을 삭제한 경우
• 기기를 초기화하거나 분실·교체한 경우(운영체제의 백업으로 복원되는 경우는 제외)
• 운영체제나 이용자가 앱의 저장 공간을 지운 경우

기기를 옮길 때 데이터를 이어가려면 iOS의 iCloud 백업, 안드로이드의 자동 백업 등 운영체제가 제공하는 백업 기능을 이용해 주세요. 개발자는 백업의 성공 여부를 확인할 수 없습니다.

4게임 안의 보석과 마법봉

• 보석과 마법봉은 게임 진행을 돕기 위한 가상의 항목이며, 현금 가치나 재산적 가치가 없습니다.
• 보석은 판을 깨거나 보상형 광고를 보아서 얻고, 마법봉은 보석으로 사거나 보상형 광고로 받습니다. 현금으로 사는 방법은 없습니다.
• 보석·마법봉은 다른 이용자에게 넘기거나, 현금·다른 재화로 바꿀 수 없습니다.
• 이 항목들은 이용자의 기기 안에만 기록되므로, 3항에 적은 사유로 데이터가 사라지면 함께 사라지며 복구되지 않습니다.

5광고

앱은 구글 애드몹 광고를 표시합니다. 판을 여러 번 깬 뒤 가끔 나오는 전면 광고와, 이용자가 직접 선택해서 보는 보상형 광고(마법봉·보석·트레이 한 칸·시간 연장)가 있습니다.

광고의 내용은 구글과 광고주가 정하며 개발자가 고르거나 보증하지 않습니다. 광고에 표시된 상품·서비스를 이용해 생긴 문제는 해당 광고주와 이용자 사이의 일입니다. 광고가 어떤 정보를 이용하는지는 개인정보 처리방침 4항에 있습니다.

6인앱 구매와 환불

앱에는 "광고 없애기" 상품 하나가 있습니다. 한 번 사면 계속 유지되는 비소모성 상품이며, 사면 앱의 광고가 표시되지 않습니다. 게임 안의 보석·마법봉은 돈으로 팔지 않습니다(4항).

• 가격은 각 스토어가 이용자의 국가·통화로 표시하는 금액이며, 스토어의 가격 정책에 따라 달라질 수 있습니다.
• 결제는 Apple App Store 또는 Google Play가 처리합니다. 개발자는 결제수단 정보를 받지 않습니다.
• 따라서 환불도 각 스토어의 정책과 절차를 따릅니다. 개발자는 스토어를 거치지 않고 직접 환불해 드릴 수 없습니다.
  • Apple: reportaproblem.apple.com에서 환불을 요청합니다.
  • Google Play: Play 스토어의 주문 내역 또는 구글 환불 도움말을 통해 요청합니다.
• 구매한 항목은 앱의 계정이 아니라 스토어 계정의 구매 기록에 묶입니다. 기기를 바꾸거나 앱을 지웠다 다시 깔았다면 상점의 "구매 복원"을 눌러 되찾습니다. 산 것과 다른 스토어 계정으로는 복원되지 않습니다.
• 이 약관은 「전자상거래 등에서의 소비자보호에 관한 법률」 등 이용자에게 보장된 청약철회· 환불 권리를 제한하지 않습니다.

7금지 행위

이용자는 다음을 해서는 안 됩니다.

• 앱을 역설계·역컴파일·변조하거나, 변조된 앱을 만들어 배포하는 행위
• 메모리 조작·치트 도구 등으로 게임 진행이나 보석·마법봉 수를 임의로 바꾸는 행위
• 자동화 프로그램(매크로·봇)으로 앱을 조작하거나 광고 보상을 반복해서 얻는 행위
• 광고를 부정하게 클릭하거나, 광고 노출·보상을 인위적으로 부풀리는 행위
• 앱이나 앱에 포함된 도안·그림·음악·글을 개발자의 허락 없이 복제·배포·판매하거나 다른 저작물에 사용하는 행위
• 앱의 정상적인 동작을 방해하거나 개발자·제3자의 권리를 침해하는 행위

개발자가 확인할 수 있는 서버가 없으므로 계정 제재 같은 조치는 없지만, 위 행위로 이용자에게 생긴 문제(진행 데이터 손상, 스토어의 제재 등)에 대해 개발자는 책임지지 않습니다.

8지식재산권

앱과 앱에 담긴 도안·그림·로고·소리·글·코드에 대한 저작권을 비롯한 모든 권리는 개발자 또는 정당한 권리자에게 있습니다. 이용자에게는 앱을 개인적·비상업적으로 즐길 수 있는, 양도할 수 없는 사용 권한만 주어집니다.

플레이 화면을 촬영·녹화해 개인 방송이나 영상으로 올리는 것은 허용합니다. 다만 앱의 도안이나 그래픽만 따로 떼어 배포하거나 상품으로 파는 것은 허용하지 않습니다.

9서비스의 변경과 중단

개발자는 앱을 개선하기 위해 도안·규칙·화면·게임 내 항목의 값을 바꿀 수 있고, 기능을 더하거나 뺄 수 있습니다. 부득이한 사정으로 앱의 제공을 중단할 수도 있습니다.

이용자의 데이터는 이미 기기 안에 있으므로 서비스가 중단되어도 이미 설치된 앱은 계속 동작할 수 있으나, 운영체제 업데이트나 광고 서버 상황에 따라 정상 동작이 보장되지는 않습니다.

10보증의 부인과 책임의 제한

앱은 있는 그대로(as is) 제공됩니다. 개발자는 앱이 오류 없이 동작하거나 특정 목적에 적합하다는 것을 보증하지 않습니다.

개발자는 관련 법령이 허용하는 범위에서, 앱의 이용으로 발생한 간접·부수적·특별손해와 데이터 손실에 대해 책임지지 않습니다. 다만 개발자의 고의 또는 중대한 과실로 인한 손해, 그 밖에 관련 법령이 책임 제한을 허용하지 않는 경우에는 그러하지 않습니다. 소비자보호에 관한 강행규정이 이용자에게 부여한 권리는 이 약관으로 제한되지 않습니다.

11준거법과 분쟁 해결

이 약관은 대한민국 법에 따라 해석되고 적용됩니다. 다만 이용자가 소비자로서 거주하는 국가의 강행규정이 더 강한 보호를 제공하는 경우 그 규정이 우선합니다.

앱과 관련해 다툼이 생기면 먼저 문의 메일로 원만한 해결을 시도합니다. 그럼에도 해결되지 않는 경우 소송은 「민사소송법」이 정한 관할 법원에 제기합니다.

12약관의 변경

개발자는 필요한 경우 이 약관을 바꿀 수 있고, 바뀐 약관은 이 페이지에 게시한 때부터 적용됩니다. 이용자에게 불리한 중요한 변경은 앱 업데이트 설명으로도 함께 알립니다. 변경된 약관에 동의하지 않으시면 앱 사용을 중단하고 삭제하실 수 있습니다.

Gem Coloring Terms of Service

1Acceptance of these terms

These terms govern your use of the mobile game Gem Coloring (the "app"), provided by the independent developer salary crew (the "developer"). By downloading, installing, or using the app you agree to these terms. If you do not agree, please do not use the app and delete it.

The terms of the store you downloaded the app from (Apple App Store, Google Play) also apply. Where these terms conflict with the store's terms, the store's terms prevail.

2What the service is

• The app is a single-player puzzle game in which you return scrambled gems to their correct places to complete a picture.
• There is no sign-up or login, and no interaction between players such as chat or multiplayer.
• Once installed, the app is playable offline. An internet connection is needed to show ads.
• The app is free to download and supported by advertising. There is one paid product that removes the ads (section 6).
• Korean, English, and Japanese are supported.

3Your game data

Completed puzzles, star ratings, saved progress, gems, wands, and settings are stored only on your device. The developer runs no server that keeps this data.

As a result, game data cannot be recovered in the following cases. Please be aware of this in advance:

• You delete the app
• You reset, lose, or replace your device (unless restored by an operating-system backup)
• You or the operating system clear the app's storage

To carry your data to a new device, use the backup facilities your operating system provides, such as iCloud Backup on iOS or automatic backup on Android. The developer cannot verify whether a backup succeeded.

4Gems and magic wands

• Gems and magic wands are virtual items that help you progress. They have no cash or monetary value.
• Gems are earned by completing puzzles or watching rewarded ads; wands are bought with gems or received from rewarded ads. There is no way to buy them with money.
• Gems and wands cannot be transferred to another person or exchanged for cash or other goods.
• Because they are recorded only on your device, they disappear along with your data in the situations described in section 3 and cannot be restored.

5Advertising

The app shows Google AdMob ads: interstitials that appear occasionally after several completed puzzles, and rewarded ads you choose to watch for a magic wand, gems, an extra tray, or extra time.

Ad content is determined by Google and its advertisers; the developer neither selects nor endorses it. Any dealings with products or services shown in an ad are between you and that advertiser. What information advertising uses is described in section 4 of the Privacy Policy.

6In-app purchases and refunds

The app offers a single product, "Remove Ads". It is a non-consumable, one-time purchase that permanently turns off the ads in the app. Gems and wands are not sold for money (section 4).

• The price shown is the amount each store displays in your country and currency, and may change under the store's pricing policies.
• Payment is handled by Apple App Store or Google Play. The developer does not receive your payment details.
• Accordingly, refunds follow each store's policies and procedures. The developer cannot issue a refund outside the store.
  • Apple: request a refund at reportaproblem.apple.com.
  • Google Play: use your order history in the Play Store, or Google's refund help page.
• Purchases are tied to your store account's purchase history rather than to an account in the app. On a new device, or after reinstalling, use "Restore Purchases" in the shop. A different store account than the one used to buy cannot restore it.
• Nothing in these terms limits the withdrawal or refund rights granted to you by consumer protection law.

7Things you must not do

• Reverse engineer, decompile, modify, or distribute a modified version of the app
• Use memory editors or cheat tools to alter progress or your gem and wand counts
• Use automation (macros or bots) to operate the app or repeatedly farm ad rewards
• Click ads fraudulently or artificially inflate ad impressions or rewards
• Copy, distribute, sell, or reuse the app or its patterns, artwork, music, or text without the developer's permission
• Interfere with normal operation of the app or infringe the rights of the developer or others

Because there is no server for the developer to inspect, there are no account penalties. However, the developer is not responsible for problems these actions cause you, such as corrupted progress or action taken by a store.

8Intellectual property

All rights, including copyright, in the app and its patterns, artwork, logo, sounds, text, and code belong to the developer or the respective rights holders. You are granted a non-transferable right to use the app for personal, non-commercial enjoyment.

Capturing or recording gameplay for personal streams and videos is allowed. Extracting the app's patterns or graphics to distribute separately or sell as merchandise is not.

9Changes to and discontinuation of the service

The developer may change patterns, rules, screens, and in-game values, and may add or remove features in order to improve the app. The developer may also stop providing the app if circumstances require it.

Because your data already lives on your device, an installed app may keep working after the service ends, but correct operation is not guaranteed as operating systems and ad services change.

10Disclaimer and limitation of liability

The app is provided as is. The developer does not warrant that it will operate without error or that it is fit for any particular purpose.

To the extent permitted by applicable law, the developer is not liable for indirect, incidental, or special damages, or for loss of data, arising from use of the app. This does not apply to damages caused by the developer's wilful misconduct or gross negligence, or in any other case where applicable law does not permit such limitation. Nothing in these terms limits the rights granted to you by mandatory consumer protection law.

11Governing law and disputes

These terms are governed by and construed under the laws of the Republic of Korea. Where mandatory law of the country in which you reside as a consumer provides stronger protection, that law prevails.

If a dispute arises, please contact us by email first so we can try to resolve it. If that fails, proceedings may be brought before the court having jurisdiction under the Korean Civil Procedure Act.

12Changes to these terms

The developer may revise these terms when necessary; revised terms take effect when posted on this page. Significant changes that disadvantage users will also be noted in the app's update notes. If you do not accept the revised terms, you may stop using the app and delete it.
